The issue here is that a company needs to vigorously defend its trademark claims or it risks the trademark becoming generified and a loss of registration rights.

Many companies did issue cease and desist letters and some titles were indeed pulled as a result.

The 1st Amendment says nothing whatsoever about what private entities such as HOA’s can or cannot do.

Except this is not a municipal (i.e. government entity) ban. It’s a ban by a private entity (the HOA) of which the First Amendment says nothing whatsoever.
