If you’re passing someone, it isn’t safe to move over UNTIL there is adequate distance between you and the vehicle you’ve overtaken. You don’t move over in a position that puts that vehicle being overtaken in a position where they’re now at an unsafe distance from you.

You, sir, clearly should never be allowed near a vehicle. Tailgaters in these situations are reckless drivers and unpredictable. Any move is dangerous. Let them make the move, then when they’re gone and it is safe to move over, THEN do it.

I’m talking about when I’m passing someone (and going with the flow of traffic in said passing lane) and some asshole comes up tailgating. I don’t have a lot of choice in terms of getting over “before it’s critical”

Rules of the road require me to move over when it is safe to do so. When I’m passing, it isn’t safe to move over when there’s a tailgating asshole swerving through traffic.

Nope. Only breaking the law if it is safe for me to move to the right. I’m never in the passing lane except to pass, and will move over as soon as it is safe. It isn’t safe to move over with a tailgating asshole who will likely make a rapid move into the adjacent lane *before* it is even safe for me to move over.

I always drive in the right lane and move to the left only to pass. That’s what I’m talking about here. I’ve moved over to pass, am keeping up with traffic flow in that lane and the asshole is still tailgating.
