The McDonald’s arches are a registered trademark. There are statutory damages available for unauthorized use of a registered mark, which I believe can be recovered even if there’s no showing that the infringer actually succeeded in diverting any sales.

Nitpick: It would be a trademark infringement rather than a copyright infringement, but I doubt McDonald’s would pursue the matter either way in this situation.
