I guess it's a bit more of the former, though I think that's also a mischaracterization. It's about the tone of how the act is discussed and how we view it. Because crime is not only treated differently, but caused differently.

I'm sorry, but you're just explicitly wrong. He left one woman alive so she could "spread his message" and had been talking to his roommate about starting a race war for months. His goal was explicitly to terrify and target a community of people and inspire fear that there would be more actions to follow.

Burning the US flag is explicitly and emphatically not illegal (and was at one time considered the proper way of disposing with old ones, since it was honorable). Naturally, it's also perfectly legal to burn the Confederate flag (though there are environmental issues around burning flagsā¦)
