That statement doesn't suggest Stewart think's it should be illegal either. He just thinks kids shouldn't be able to buy it. That's the near unanimous stance of everyone on either side. He also says he knows it's free speech.

He was making fun of the inconsistency between protecting violence as free speech and not sex. That's a perfectly fair criticism and he makes no suggestion that depictions of violence should be regulated.
