I don't think anybody's siding with Torrent users. I don't make this point because I'm somehow for piracy. The point is that I should in no way feel compelled to give money to a company just because they sent me a threatening letter over something that's notoriously dubious to prove.

I don't think they should. If CD Projekt wants to take it to the courts, fine, but nobody should give anybody anything just because they were told to by some company.

100% sureness is impossible here. Claiming that it's so is a bending of the truth and a bullying tactic. I understand that saying how they obtain their information might put their ability to gather the information at risk. But that's no excuse for one-sided threats and arbitrary demands.
