Am I the only person confused by the difference between the “coming this month” statement in the opening sentence and the “third quarter of 2017" delivery estimate towards the end? To me, “coming this month” means “available for purchase,” not “pictures on the internet.”

I can only imagine that happening if the appeals court found that Berman decided some legal question wrong in a way that affected the facts that were presented to the trial court. My bet would be for a straight reversal rather than a remand (assuming the panel does side with the NFL).
