There are no penalties. This is stock car racing, and this stuff happens from the local level all the way up. Always has and always will. Its an accepted part of the sport.

The rules in the WEC and ALMS are both drawn up by the ACO, and when the rotary P2 car ran, the ALMS was ran by the letter to ACO rules. Currently, the ALMS basis their rules on ACO stuff, then modifies it to suit their needs. The FiA may sanction the WEC, but the car rules are all done by the ACO.
Thing is, I actually really like rotaries. Just hate this myth.

I would say the car no longer fit the rules, which happens all the time. New ruleset means all the previous cars aren't eligible, regardless of how they're powered.
