In the same boat. I have represented black drug addicts for years and heard nothing about how it’s a public health issue - it’s always my clients’ moral failing. Very tough for me to muster sympathy TODAY of all days. I would have sympathy and energy for all but no. Not if it’s so uneven.

Can you clarify? Are you saying prosecutors should avoid challenging defenses that might implicate rape shield?

When I’ve done rape cases I’m also really careful about running afoul of the rape shield laws - i.e., no character evidence implying that the alleged victim is promiscuous. That’s not exactly the contention here but I’m surprised more prosecutors don’t challenge those types of defense strategies.

Mistaken identity or miscommunication are less sleazy ways to defend a rape charge. Granted, the former doesn’t apply here, and the latter is condescending at best, but one does need a defense. In my experience I find a little empathy toward the alleged victim goes a very long way with judges and juries.
