Owning cryptocurrency is like owning any foreign fiat currency (like the Japanese Yen for example). The US government can only regulate/tax cryptocurrency to the extent it can do so to the Yen.
If the USA banned the use of Euros (for example), people would just exchange their Euros for Japenese Yen, and then exchange the Yen for USD. Same with Bitcoins.
So I can just exchange the BTC for Euros and then the Euros for USD without a serious loss.

Cryptocurrency is not governed by any government, so it cannot be regulated, as private businesses have the right to accept any form of currency. Thus, it cannot be banned either.
