Well, responding to climate change requires relevant public policy, and that means it was always going to be politicized (at least in the U.S. where an administration’s policy will always be considered fatally wrong by the other party).

IIRC PriceWaterhouse v. Hopkins allowed for discrimination based on gender stereotypes (i.e. my view of how men and/or women should act/look like) to fall under sexual discrimination. It’s not quite the same as gender identity, but you could make the case that discrimination against transgendered people = sex…
