The fact is that they’re using other people’s labor, time, and creativity, without permission in the hopes of material gain. Just because they fail at their goal does not mean that the theft did not occur.
But the overall hoped-for effect is for the company to profit. They wouldn’t spend money on a thing unless it’s to profit it from it eventually. Just because sometimes there’s a small amount of risk involved doesn’t mean it’s not for profit. Also not all profit is strictly monetary.
