Delta was not violating rule 121.311. The context of that rule is when the child has his own seat. In other words, airlines must allow children to sit in a car seat rather than force them to sit directly in an aircraft seat.
Rules are ok to follow when they don’t kill or harm people. Asking someone to abide by the terms they agreed to is not unreasonable. You’re conflating inconvenience with genocide....
The FAA rule is that a child traveling infant in arms HAS TO FLY IN SOMEONE’S ARMS and not in a seat, because the child doesn’t have his own ticket. She stated it a little strangely but that’s the reality. BTW the FAA does regularly fine the hell out of airlines for breaking FAA rules.

If they had scanned the older son’s ticket, which would be illegal, the airline would not have put someone else in that seat. They re-assigned the seat because the passenger who was supposed to be in it (older son) didn’t show up. I would bet a lot of money that if the family had called the airline when they bought…

Because the passenger whose name was previously attached to that seat (the older child on the earlier flight) NEVER CHECKED IN for the flight. So they assigned it to someone else.
