Yes, but it seems like they would have brought it up at some point, even if they could not sue.  

If I remember correctly, and it’s possible I don’t, the scene is them waking up in bed. It’s obviously implied that they had had sex at some point the previous night, but the nudity was not sexual at all.

Just because I disagree with your characterizations and opinions. does not mean I don’t understand them. You could also attempt to explain how you believe the Earth is hollow and I would still have the same reaction.
