As someone who works in nonprofit finance - no. The 5% rule is for family foundations. If they set up a 501(c)3 or a trust with a specific designee (Bobbit, in this case), 80-90% of the funds would need to go directly to him. 

THEY didn’t raise the money. They sat back while a campaign went viral. The people who donated and shared the story were the ones who raised the money, and they did so because of Bobbit’s original selfless act.

He didn’t hire a team of lawyers. The lawyers reached out to him and convinced him that he had a case, and they are working on it pro-bono. This article even describes his hesitancy in going after the money because he is so fond of McClure.
