Autopilot is a driver assistant device. They give plenty of warning before and during use that you need to pay attention. Beyond that it is all the user’s error.

I have a Model X and have used Autopilot on a daily basis since I got the car. It warns you constantly that you need to pay attention and if it doesn’t detect your hand on the wheel after a period of time it will chime to alert you. It’s very hard to claim ignorance if you’ve actually seen the software.
