There is a diference between distracted driving (which I define as driving while doing distracting activities like using a cell phone) and a driver being distracted enough to miss a jaywalker. All it takes is somone looking to change lanes at the wrong moment, no driver fault.

The point is that there are trade-offs in everything we do. Depriving people of a choice to accept a small amount of risk for a given amount of wealth or entertainment or time saved is not the answer.
