I have an easy and extremely plausible explanation for both 1 and 2: nobody who watches Fox News does know what erudite means.

A. She was joking and B. Even if she was dead serious, it’s still no legal basis for appeal.

I agree, but I still feel the “necessary abortion” is a useful distinction when pointing out what this is really about for conservatives. If the baby, the woman’s life (or, really, anything except chaining us all to a kitchen stove and bedpost) mattered to these people, the distinction would make a difference to them.
