Did you know you can get a DWI if you have a BAC under .08%? Application of the law is subjective, and cannot be simply reduced to a objective number , ignoring all context.

"You can't prove that you received nonverbal consent. You can't prove you received verbal consent"
This is not a law for the criminal or civil legal system, so you won't ever have to prove these things in court.
Well, at least until two people are in a relationship (or are just really proactive about creating consent guideline I suppose) and have discussed with each other what nonverbal communication they would like to use to indicate consent.
Do you not understand the difference between intoxication and incapacitation?
"judge and jury to deal with"
STOP BELIEVING WHAT THE CRIME TV SHOWS TELL YOU!
Criminal prosecution is allowed to run parallel to any title ix investigation. Most victims don't go to the coos or get far with them bc there is a pervasive problem with cops being biased against victims, not interested in really doing thorough investigations (hence there being tens of thousands of unprocessed rape…
THANK YOU.
"it becomes one word against another"
This has nothing to do with innocent until proven guilty. If someone charges you with murder but it was really self defense (onus on you to prove that), that doesn't mean you are guilty until proven innocent does it?
You would have to explain what words or actions made you believe that you had consent at the time. This is the opposite of how it's done now at many places, which screws over anybody involuntarily experiencing the 3rd part of the "flight, fight, or freeze" response
??? How is risking pissing someone off worse than risking ruining someone's life?
Well, the defendant is going to have to explain exactly what acts or words led up to the assault, instead of just being able to say "well she never said 'no'" or something similar.
So, on what principle are we fighting to continue having sexual contact like this? That any sex is good sex? That's crazy. If someone is too shy to talk about sex, then they are definitely not talking about safe/emotionally appropriate sex either. People this immature should not be having sexual contact. They should…
Forgive me, because I know nothing about trying to get pregnant, but in those situations, why do they actually have sex? Why doesn't the guy masturbate into a turkey baster or something?
Well, you are never going to get 100% compliance with any social norm, but it's clear from looking at other cultures that rape is more common in places where it's tacitly condoned. Take South Africa with it's widespread beliefs in corrective rape, among pro-rape ideas. Something like 1 in 4 men openly admit to raping…
"Very long odds"??? Most people in this country don't know the first thing about what most rapes look like; how are they going to know that this tool is extremely limited in its effectiveness? You think people are going to buy it if the manufacturer advertises it like that? Heck no, they are billing it as some sort…
i think you missed the point...which is that our culture DOESN'T often say "don't rape". That aspect of morality seems to be too taboo to even be touched on by most parents and educators.
My guess (from working with rapists that have committed drug facilitated assaults) is that they will use whatever's easy to get and maybe modify their technique as they go along. Right now, it is disgustingly easy for anyone in this country to get a huge supply of benzos and related z-drugs (like ambien and lunesta)…
