Um yeah.....all crimes have a sentence range and 1 year doesn’t seem all that outrageous to me as the maximum.

CA misdemeanor probation is essentially just not getttjng arrested again.... the 4th amendment stuff is by far the biggest issue, but in practice it will probably be a non-issue because no one will ever search her. Her statement is really vague. She says ‘they’ told her that she could spend up to year in jail. For all I know, her own attorney said that to her when explaining possible outcomes of the case.

While I’d LOVE to keep guys like this under constant surveillance, no police department has the capacity to do so. There are way too many of them.

The shouldn’t be allowed access homes where the owner isn’t home to show unsuspecting clients around.

But it’s not even like the prosecutor asked for a year. 1 year is just the maximum possible. Who even knows what the prosecution would ask for if she gets convicted.

Also it should say ‘California woman faces misdemeanor charge . . .’

Misdemeanor probation in California has basically no requirements. And you can get the misdemeanor expunged entirely off your record after you complete probation. So yeah, it’s basically an infraction.

And also: SHE’S NOT GOING TO JAIL.

She’s not going to jail. The one year is the -maximum- sentence for a misdemeanor in California. Actually it’s 364 days. Shes being charged with a misdemeanor. That’s the max sentence.

I 100% guarantee that she will not get a year in jail. That’s the theoretical max penalty for a misdemeanor. This article is being seriously over dramatic.

I’ve never seen a Trader Joe’s employee look unhappy. Or seem like they were trying to hard to chat. If anything, they might make a comment about whatever item in my cart they also like.

I can’t speak for the whole ‘American system’ other than to say that’s it vastly different in different areas and your description is patently false in many areas and there’s really nothing I can say to convince you of anything if your mindset is already all-prosecutors-are-evil-and-nothing-will-convince-me-otherwise.

Except there was no ‘coercion.’ And no threat of ‘draconian punishment’ for contesting the charges. There just the possibility of actually getting a some time, which might not have happen or might not. The defendants have their own attorneys and often very good ones. And all of their attorneys knew exactly what I was

I feel like when there is a story about a rapist and someone comments about prison conditions, it’s like when there is a story about a black man being gunned down by police and people start talking about black-on-black crime or black men committing crime or whatever.
