The best solution is putting all of the responsibility with the driver(which it is), until the car is certified to be fully autonomous (which the Tesla isn’t).
So we never make any assumptions about its capability, rather study in depth, its limitations. That, and there is the mandatory checks every 6 months to prove we get it.
Design the system to recognize that the driver is not behaving in a safe way, transition the vehicle to a safe (non-driving) state, and disable autopilot features in a non-trivial way.
