I think you confuse copyright with trademark. This group made a game which causes “trademark dilution” or confusion in the marketplace. They can be sued for that.
People also fail to thing of the bigger picture. I’m pretty sure they’ve tried to take down all the fan made games, especially ones that use their assets. Problem is some of these games get hosted in countries that won’t acknowledge a copyright/trademark and therefore won’t take down the material (hence why pirate bay still exists.)
That’s wonderful for copyright. But “pokemon” is a trademark, which you DO have to defend or it weakens.
