I’m not an expert on litigation finance by any means, but lots/most/almost all plaintiffs lawyers work on contingency. This is not that different from a lawyer working on contingency (and probably ends up with the plaintiff recovering a higher percentage of the award because of the scale).

Point taken, but the key difference is that, after the ‘94 midterms, the GOP had unified control of Congress.
