Again, you need to understand licensing. You can release on a public license with restrictions, such as not profiting or requiring credit. If a rights holder releases wide open without requiring anything, they can’t complain when people don’t give credit or make a profit.

They did change the formula, though. They crammed the Batmobile in and made every third mission about clearing they way for it. A ton of the Riddler trophies require the Batmobile. The Firefly missions, the bomb missions, the APC missions, etc.

Breach of license is a crime. If Hyperkin did something illegal they can be sued. If someone didn’t release under the correct license (requiring credit), that isn’t Hyperkin’s fault.
