This is a classic example on why I cant stand those people who keep harping our rights are only protection from the government. Technically, yeah it is. But the spirit of the Bill of Rights should cover more aspect of our lives.

The lesson based on this story is that they will suspend to give the appearance or caring regardless what the people in charge of fact finding think.

The issue here is that the LEAD investigator apparently did not recommend suspension. Not just a regular employee.
