What’s more is that RDR on xbox will actually get 60 fps at some point. FPS boost is already a feature for a lot of BC titles and those running in dev mode have found that 360 emulators can run at 60 FPS on both the series S and X.

That is not a complex process. Hell for some people in the world with spotty internet this can easily occur unintentionally which is likely how it was discovered in the first place. dropping ban hammers for something that genuinely only affects the player themselves and is easily corrected is definitely overkill.
