‘Visibly intoxicated’ is included in these statutes (and only in the civil liability side, to my knowledge) because a server can claim they were drinking prior to coming in. If you serve someone to the point of intoxication, you will be on the hook. (CO was one of those states where I got certified.)

Yes, it’s illegal to serve someone to the point of drunkenness in many states - server and establishment are civilly and criminally liable. Ever see a bar deal with a drunk asshole and not call the cops when they would be justified in doing so? That’s why - they weren’t supposed to get the asshole drunk to start with.
