Sure, but in those situations the threshold of competence tends to be set low to prevent debates on what is acceptable. We let people who seem quite crazy defend themselves at trial, for example.

Maybe this is fine? If you can document cases of real crimes that they are intentionally slow-walking and not pursuing, that’s one thing, but if they’ve stopped grabbing people off the street for minor infractions a la Eric Garner that’s actually a desirable outcome.
