ICS being shown on the Nexus S didn't have the software buttons. It used the hardware buttons instead. Which makes perfect sense.

Most newer phones, both Android and iOS, on all carriers are starting to have their default tethering send that data through an entirely different APN. How much data you use and your user agent string can't change that.
