You jest, but I was just reading a blog post by an 'alterna-mom' arguing that very fact. It is her RIGHT not to vaccinate her children and if one of her children infects yours with measles, why is YOUR child's health more important than hers?!

CA state law used to be that the mother was the person who gave birth to the child. Not sure if that's still the case, but there were several instances of surrogates successfully filing for custody because of the way the law was written.
