My understanding of the accident is that it was something that could have occurred with many drivers. Truly tragic, of course. But I don’t think people want to admit that they are just as capable of making the same mistake, so they try to blow up the mistake to huge proportions.

That’s interesting - I practice in Canada, and at least in my neck of the woods, it can be entered into evidence. Not wearing a seatbelt is likely to result in a finding of contributory negligence, which is likely to result in losing a portion of your damages. I agree - it’s contributory negligence. If I am injured much more severely because I CHOSE to not wear a seatbelt, then I contributed to my injury. That should (proportionally of course) be on me.
