I've found that much of this advice is wrong.

Yesterday, I wrote a small game for my son. You move two squares around the screen using the thumb sticks, the triggers increase the size of the squares, start and select clear the screen. In this circumstance, the developers themselves are providing the game for free, so it isn't piracy. They are providing an implicit license to use the game without compensation.
