I disagree that they do so “routinely,” but to the extent that happens sua sponte, it’s presumably for a facial lack of jurisdiction. Here, the court has jurisdiction. Transfer is not typically mandatory, it is discretionary. Accordingly, I’d expect the court to hear arguments.
