I am going to assume that if the owners were hiring people to work the mine until other issues arose that it was at least reasonably productive. A similar reference to a subcontracting arrangement makes me think that they have a documented evaluation. That may be an unfair assumption, but it makes sense.

IANAL, but I am pretty sure that isn’t how imminent domain cases are normally decided. i.e. The fact that there is now a 4-lane highway right outside the door(decreasing value) does not factor into imminent domain valuations.
