You're on to something, but you haven't taken this to the final conclusion. We have a problem and it's a problem of socialization. Men are perfectly capable of not acting like this, but yet it's still prevalent. There's no surprise, just one very deep sigh.

That depends on the space. If the photos are taken inside the convention center that is not a public space, it's privately owned. Technically you could stand outside a convention center and take photos and never even require permission from the people standing in line. That's how all of those scum fuck paparazzi

No it's considered fair use. The subject of the photo isn't the character being displayed, it's the person in the photo. Now if a cosplayer wants to get payed to show up as Batman at birthday parties and comic shop openings, that may be a different matter.

With regards to photographs the subject of that photo has no legal rights beyond granting or denying the photographer permission unless the subject enters into an agreement with the photographer. Once permission is granted it's the photographer who owns exclusive rights to the use of the said photo.
