The company that owns the intellectual property that you are using is the one that gets to draw the line. This isn't a "I paid for this I should be able to use it however I want" situation.

I wish more people felt this way about gaming. Console wars and fanboyism is stupid. Personally I try to buy all consoles every generation if I can afford it just because they all usually have something I want to play and isn't gaming suppose to be about the games anyway?

Honestly, Sony and Nintendo aren't really rivals anymore. Wii U attracts a different market than the PS4, they're not really competing for anything. And on the portable side... well, sadly the Vita is as good as dead in comparison with the 3DS, so there is no competition whatsoever.
