Sorry but the reality of whether or not the cheater cheated with someone the same gender of their spouse is a significant part of the puzzle. The effort to make the whole thing gender free made me think that was what happened...and in that case it does matter.

I assume these are cases where the victims know the attacker. The added level of scrutiny is likely because law enforcement is trying to assess their ability to prove the case in a court of law...and that is just going to come down to the victims testimony.
