No. You’re probably thinking of instances where evidence was withheld until trial, or never turned over at all. This was apparently disclosed well before the trial date (if a trial date has even been set). The case may get dismissed but not because of withheld evidence.
New York has pretty much the worst discovery laws in the country, saying that the State (or the People, whatever) can basically wait til immediately before trial to turn evidence over. Four or five months post-indictment is probably, sadly, a relatively short time.
Withholding evidence in a criminal prosecution is (supposed to be) a really big deal.
You’re also leaving off conflicts of interest, which might be the most frequent reason for withdrawing.
It’s not nearly that simple.
Juries aren’t built. They are carved down using a series of peremptory or for-cause strikes. You have little control over who the other side strikes, unless you can show it was purely based on race or gender.
