He is already charged with murder, as the article says. Apparently in Maryland “hate crime resulting in death” is a wholly separate offense.

I’m a public defender. I get cases thrown out on “technicalities” (usually some pesky little violation of an amendment to the United States constitution) all the time. Are all the woke liberals in the comment section of this article upset about that?

Uh, no, I’m saying that if that was how the jury split, it wouldn’t have been a mistrial. It would have been a conviction for manslaughter. The author was wrong to speculate that the jury split 6 guilty of murder, 6 guilty of manslaughter, because that would equal 12 guilty of manslaughter and no mistrial.

And that was not meant to overlook the point you raised, which is that Batson challenges are easily overcome by the government. The podcast More Perfect addressed this in their episode called “Object Anyway”. But I’m not sure what the solution is myself.
