I can see issuing a hand gesture with a voice command being much faster than holding the LB button to open a wheel menu and spinning it down to the command I want to use and then pressing A. Quicker games probably won't have them or use them well, but more tactical games could totally work.

I doubt any publisher would ever give permission. The reason Let's Plays are a thing right now is because people just did them. If everyone has to get permission from each game publisher/license owner from now on, nobody would make them.
