microsoft never likes people getting the game early. they arent super strict, but they will send out notices and give warning if it gets out of hand. in this case, target will be heavily fined for each console shipped.

Xbox one... not at launch. post launch update will add support. WiiU had it since launch since their hard drives arent even upgradeable and know that people will fill 32gb(realistically 27gb) pretty quick.
