2006 was 15 years ago. When I first started playing games around 2000 or so, there were plenty of internet forums where games much less older than 15 years were considered “retro” and waxed nostalgic about.

You’re confusing patents and copyrights. Copyrights protect specific works (like code in this case), patents protect inventions (like the algorithm, in this case). Though this is really stretching the concept of “invention”
