It's not a clever differentiation... the differentiation IS the invention. In order to infringe on a patent you have to have every element of the Claim. Just read Claim 1 and you'll understand.

They did not patent an analog stick, but rather, a while-holding-a-controller-finger-operated-joystick.

Perhaps everyone is paying Nintendo a licensing fee, and we just don't know it. After all, patents aren't only used to block other people from using it.
