1) They aren't being punished by law. CDP and the law firm they hired are sending notices that basically say "pay up or we'll sue", and the one being alleged of piracy usually cannot hire even a lawyer to defend them, let alone experts for their defence.
I'm not a fan of piracy, either, but I am a fan of evidence-based law.
Contest it in a court where knowledge of IP law is necessary for a proper defence, and the only way for any given individual to do so is to hire a lawyer?

A sharing ratio of 20:1? Most people who torrent don't do that. Most would stop the download after downloading it and upload speeds are notoriously slower than download.
