What someone CAN do and what they might have time to do are different things.

A waiver doesn't eliminate your right to sue. It merely acknowledges risks you are undertaking. If the vendor is negligent, they are still liable. Not a lawyer, so I'm not sure what the limits of forced arbitration are.
