Nope, you do not lose the warranty if you do not buy it. It does extend the warranty above 50k miles/4 year new vehicle warranty on the car. (you still get 8 year unlimited mile warranty on drivetrain without it)

It is invoice price, there is nothing shocking about it. Keep in mind invoice price already has the manufacturers profits factored in. The dealer just adds on top their markup.

I think the reason why GM is fighting here while other automakers are not. Was because as part of the GM bailout, there were some provisions that involved dealers as a condition for their bailout.

You are half right, but also half wrong. Yes, the franchised dealership model is very old. But initial laws only protected franchising contracts, they did not force a manufacturer into franchising. The oldest laws that did these were made in 1970s, but many are as recent as 2000s. These aren’t old laws as people think…
I think you are confused about what this issues are about. The issue here is about “franchised dealerships” vs “manufacturer owned dealerships”. Tesla wants manufacturer owned dealerships, and not to franchise.
