There are numerous ways around it; these kinds of rules are flexible in every university I have ever been associated with. You can do an independent study, you can get a course equivalency in another course, the professor can withdraw and another professor can teach; basically at my university the department chair

There is no automatic power differential. In many cases there is, but it is not automatic; categories do not determine power.
