I think it's all pure BS as well, and hope we can make some changes to copyright law someday. I just happened upon the knowledge of "you need to defend your copyright to the death, or else others will use it against you" a while back, and think that's the most messed up part of it, since it more or less forces people

To my knowledge these situations are made worse by the fact that copyright holders need to show them defending their copyright in these situations, since if they don't, they won't be able to do so in other contexts, and these situations can be used as a defense to show that the copyright holder doesn't actually care
