It matters more what the cops/court identifies him as, doesn't it? As for me I was thinking "Shit. If he does get jail time, that will mess with TV shows I'm looking forward to, and if he doesn't, then that's kind of depressing too". You can totally just not watch the show. :P But I understand your issues with it. I fast-forward through most scenes with Desi, Marnie, Adam or Jessa myself, but for me there's enough good stuff there to watch it until the season and show ends.
I think most people with Hannah's background would be oblivious to that, so it doesn't seem unrealistic. I hadn't thought about it, though I probably would if it were me having a kid. But it would be great to see it addressed on the show.

Unless they use a wig. :P But race isn't = appearance, which I think is made clear by how no one has even considered that Snart could be anything other than white until they're informed of the actor's background.
