It is in some states, not in others. But everywhere it is the accepted convention. People aren't required to follow it everywhere.
Sure they're being unsafe. But instead of making it worse and increasing the accident potential, you could move over and actually reduce the chance of incident.

Every corporation will try to do everything as cheaply as possible. Corporations exist to make profits. Without the profit incentive, I can't think of many companies that would be willing to make a product and you'd have a hard time pitching an idea to investors that doesn't generate it.
